Who do I claim against for the wrongful seizure and disposal of my car by the Met Police?
Police seized it because it came up on the MID as having no insurance (Tesco still hadn't put it on). I told them I was waiting for my policy. Police said they seize all cars not on the MIB. I didn't have £300 to release it so they crushed it. It was proved in court that I did have insurance. The pound said they can only give salvage value of about £200 even though the car cost £9500 to buy 2 months ago. When I asked who to claim for all my losses from they said they can't help and I should see a lawyer or the CAB.
I can understand being stopped and questioned because the car was not on the MID. But I showed my licence and gave them particulars of my insurance even though I did not have any documents to prove it; it was early afternoon on a Friday and they could have checked with Tesco Insurance.
Get yourself a lawyer. They'll do this one on a no-win no-fee basis. If you produced a Certificate of Insurance and they ignored it, the Police have broken the law. You can expect to get all of your money back plus damages for abuse of procedure and the lawyer will get his fee paid.
