
Can this man hold my car just because he paid to get it out of an impound?
Last month my car was put into an impound because I was unable to pay for my insurance and got pulled over. I was able to pay the $125 to get it out but I was unable to because the title had a lien on it. Being the the previous owner did not transfer it over correctly, I could not get my car out before they started charging me $20 per day. So the previous owner, without so much as telling me, went and paid the money and used his old bill of sale to get the car out. I did not find this out until I called the towing company. Now he is holding my car until I pay him $145 for the total cost of removal from the impound. I do not feel like he should be able to hold my car because if it weren't for him transferring the title wrong, I could have gotten my car myself. What can I do to get my car back?
Nothing. He had a right to protect his security. You are no worse off, you would have had to pay the impound lot in any case. Pay him instead, you are no worse off, you will have your car. Simple.
Oh, and thank the previous owner for saving you storage fees.
By the way, it is YOUR responsibility to ensure that the title is transferred, not his.
