
Can I file a motion to reconsider sentence on a multiple infraction conviction in CA?
I was convicted of 5 of 10 code violation infractions I was charged with. The judge took the case under consideration at the end of trial, and issued the ruling several weeks later(which the clerk never notified me of, I had to go there to check, but I digress). I signed up for community service before the fine due date(June 20), but I want to ask the court to reconsider the 5, $352 fines(for having cars on my property with no current registration! probably the most expensive parking ticket in history), as they represent more than 1 month's earnings for me. Can I appeal the conviction after I sign up for community service, or only if I pay the fine cash? San Joaquin County, CA, if that matters.

You can always file a motion for reconsideration. It is an inherent power of the Court to vacacte an inappropriate order or an unjust. I suggest that you call it "inappropriate" if you hope to have some success with the the motion. I am assuming CA law is similar to most jurisdictions. The only difference CA probably has acode offense for most every aspect of dailty living. Maybe, you can file a notice of appeal and do the community service. You have to protray respect for the Court. No matter how you may feel. This is just a common sense approach to solving a problem. And dont talk too much in jailhouse. Or anywhere else.
