A 1967 Car Titled in new jersey, Being Junked In P. A. Not By Owner With No Title - How Is This Legal ?
MY FATHER PASTED AWAY IN 2001 (4 DAYS AFTER TWIN TOWERS FELL) I WAS ABOUT 15 AT THE TIME. HE OWNED A 1967 PONTIAC AT THE TIME, NOT IN THE BEST CONDITION BUT DRIVABLE. I HAD NO ROOM FOR STORAGE SO AN UNCLE IN PENNSYLVANIA OFFERED (HE OWNS A MECHANIC SHOP) , FROM 2002 HE HAD IT THERE. OKAY WHAT I NOW KNOW I DID WRONG WAS NEVER RE-REGISTER IT WITH MYSELF OR AT LEAST THE TITLE TO MY NAME. ANYWAY COMES 2005-2006 I FIND A SPACE I CAN STORE AND WORK ON THE CAR AND MY UNCLE TELLS ME....(A TEAR DROPS) HE TELLS ME... HE "JUNKED" A FEW MONTHS AGO BECAUSE HE FIGURED I WASNT DOING ANYTHING WITH IT. I NEED ADVISE WHAT DO I HAVE TO ACCEPT AND WHAT CAN I DO. I LOVED MY FATHER AND HE LOVED THIS CAR, WHAT CAN I DO AND WHAT SHOULD I HAVE DONE ? THANX FOR YOUR TIME, APPRECIATE ANY ADVICE !
Well by law you gave him a verbal contract to keep the car and after a couple of years of not doing anything he assumed you didn't want it and junked it. He doesn't need a title to junk it. If you want you can go down the the junk yard and hopefully find the car, but that is a slim chance, since they completely damage all the cars into scrap. You should have told your uncle that you were going to take the car eventually and he had no authority, but remember you left it with him and he had no use for it and he kept it for 5 years. Nothing you can do now. One thing I've learnt is that you will always have your father's memories and holding on to something materalistic is not a way of remembering him, you always have him there.
