Car collision, who's at fault ?
Accident took place in a city of nj. As i was making left from Broadway onto 3rd st, passing two park cars away, the third car decided to pull out and hit me on the passenger side, scrapping the rear with his tires and tip of his bumper. I tried to avoid it but it was impossible because there was cars to my left and the man didn't want to exchange information, until the cops shows up. Regarding to insurance who at fault, who pay ,and if the person not at fault do they have to pay the deductible ? My car is 1994 Mercedes Benz e-320 mint condition and his was a late model expedition, i would say a 90's model.
The insurance companies decide who is at fault and the percentages of fault, and adjust their payout based on their negotiations. Usually a police report will contain all the important info in regards to the accident and the officers opinion as to who's fault or which vehicle made contact first.
