Scrapping A Car In Nj
May 30th, 2010 by admin

Can u recover 4 property damage 2 a vehicle in NJ resulting from an accident if u sold the vehicle after?

My boyfriend was recently in an automobile accident. He was not injured, but his car was pretty smashed up. It was an older Mercedes with a decent amount of miles on it, so he did not have full coverage. Within a few days of the accident we visited a body shop and supplied the owner with information regarding the car and its current condition. The gentleman advised us that it would not be worth fixing (total loss). We took pictures of the vehicle and sold it to a scrap yard. We have since received a copy of the police report and it is clear that the accident was not his fault. We are attempting to recover from the other driver's insurance company. The company has denied the claim because my boyfriend is no longer the owner of the vehicle. Do we have any recourse?

Yes. Your boyfriend did not transfer the claim with the vehicle. Your boyfriend incurred a loss for which he can be compensated. He should file a lawsuit.

Dana (attorney)
