car sold as is now wants money back please help 10 points?
well yesturday i sold the car as is for 11,000 today this person has a problem with the car none of it is my fault ( the problems) me and the buyer already know that its the guy i baught it from tht made the problem ( ministry of transportation knows it too) now the person that baught the car from me want money back but i forgot to tell her to sign the bill of sale the car i sold it without safety and emission which makes it as is ....... IS THERE ANYWAY I WOULD HAVE TO GIVE THE MONEY BACK COULD I BE IN TROUBLE IF I DONT????
ur on the hot seat,the 1st thing u do went u sell a car as u get the money, is sign the transfer of title ,u didn't so technically this car is urs and u took 11,000 from this buyer,U should have protected urself by making a letter as is ,notary with the new owner ,establishing the problems with the car and the as is ,I'm guessing u didn't ,so what's next u don't give the money back, they take u to court,I don't know all the details about ur case ,but the judge will probably ruled on their behalf ,unless u can prove that the ones that messed up the car was this new buyer,and that the car during ur possession was in excellent condition,(which u just admitted it was the previous owners u bought the car from that establish this problem with this car,Even if you buy a car from a dealership,there is a law that protect consumers over bad lemon car deals.If this new buyer knew about the problem ,and u told them about it is ,u can try and negotiate with them say,No I already sold u the car and u new about the problems, what I can do is take it to the mechanic to fix the problem(u might have to fork in some of this 11,000 to fix the problem)see if that will ease the problem,and get a mechanic urself with their estimate,If they agreed to this great,Fix the problem ,please after have them sign the papers,and that's it.If they don't agreed to this and u don't want to give the money get ready for court.Next time u sell a car ,try doing it in a public place,to strangers,not people that know where u live or know u,(Even if u sell a decent car for a good price)u will never know to what kind of person u sell the car ,after they come to harass u,If u don't want to deal with the buyer and don't want to go to court ,give the money back.Consider everything I told u and whatever u decide to do,think twice about ur actions, best of luck to you
