Used Cars Cash And Carry
May 6th, 2011 by admin

Paid friend for work in cash, now invoiced 5 years later?

A friend of mine used to do work on my car for me which i paid for in cash as he was a friend - i never had a receipt or an invoice. we subsequently 'fell out' and last week i had an invoice through the post for numerous jobs that was done in 2003. Now although this work may have been done (i don't remember exactly?), i could also have paid at the time which i cannot recall? he has also threatened to increase the bill by 10% per year since the time the work was carried out if i don't pay and take me to court.

Can he do this??????

Unless he has something in writing that would make it a contract. This would probably fall under the Statute of Limitations through the Uniform Commercial Code(UCC), which is 4 years.

So basically after 2007 he is out of luck.

Even if he attempted to take you to court and was somehow in the Statute of Limitations it does not sound like he has any proof(other than his word) that he did work and you didn't pay.
