
My car got repoed and I am being sued for the remainder. I live in Florida. I own my home can I lose it?
I got something in the mail telling me I have 30 days to respond. I have to go to court and I can lose my wages and property. We have been hit really hard by the economy and we honestly have no wages for them to take. We are both unemployed. We own our home out right, completely, no payments, bought in cash. I know that in the state of Florida that the law is different, that if you do lose a lawsuit that you can still keep your home. Is this right?
Being "sued for the remainder" of WHAT? They got the car back, as security for payment of the loan, the loan is over. They don't get to take the car AND collect on the loan for something you gave BACK to them. What kind of contract would that be? In fact, you could sue THEM for return of all the payments you made toward equity in the car, as they are only entitled to the interest due on the loan.
